General Terms and Conditions
These general terms and conditions govern the legal relationship between Oh!Lingua, hereinafter referred to as "the school," and its clients, hereinafter referred to as "student" or "students." By registering, students agree to comply with the requirements of these general terms and conditions.
Admission Process
Anyone wishing to take courses with the school must first complete a placement test to assess their level in the chosen language. The test conditions are determined by the school. The placement test is free of charge.
After the test, the school organizes a short interview with the interested person to define their needs and objectives. To further refine the student's needs according to their level and goals, a trial lesson with an instructor is scheduled. This trial lesson is free of charge.
Based on this, the school proposes one or more personalized course modules with an instructor. A course module includes at least three lessons, each lasting 50 minutes, including possible breaks.
Registration
Registration for a course module is validated either by a written agreement between the school and the student or by partial or full payment of the invoice.
Payment Terms
Payment terms and deadlines are defined by the school. Generally, each course module must be fully paid in advance. Payment in a maximum of three installments is allowed. In all cases, the student may only attend lessons that have been fully paid for.
All prices are in Swiss francs. The student bears the risk associated with currency exchange rate fluctuations.
Cancellation Conditions Before the Start of the Course
Any full cancellation of a course module before the start of the course must be notified in writing to the school, which will confirm receipt in writing within three business days. Cancellation fees are as follows:

From 4 to 2 days before the first lesson: 10% of the amount remains due to the school.
Cancellation Conditions After the Start of the Course
In case of cancellation after the start of the course, 20% of the remaining module must be paid. Missed lessons do not entitle the student to a refund or a make-up lesson.
Validity Period of a Course Module
Any course module must be completed within one year from the date of the first payment made by the student. Beyond this period, any remaining lessons are forfeited and neither usable nor refundable.
Lesson Conditions
Unless otherwise agreed by the school, lessons are individual and last 50 minutes. Multiple consecutive lessons can be organized depending on the instructor's availability. Activities during each lesson are determined by the instructor based on the student's needs and objectives. Breaks can be taken during lessons but are included within the 50-minute time frame without price reduction.
Lesson Schedule
Lesson schedules are agreed upon between the instructor and the student, who also determine the lesson frequency.
Learning Materials
Online learning materials are generally provided free of charge by the instructor. However, based on the student's needs and objectives, the instructor may request the student to purchase additional learning materials, at the student's own expense. If the student does not acquire the requested materials, the instructor may adjust the course module accordingly with the school's agreement. No compensation is due, and the student remains liable for the full agreed course module price.
Homework
The instructor may assign homework between lessons based on the student's needs and goals. Homework is mandatory and considered an integral part of the training. The school is not responsible for training failures if the student does not complete all assigned homework conscientiously. If homework is not completed properly, the course module may be adjusted accordingly, with no compensation due, and the student remains liable for the full price.
Student Absence
Any absence must be notified in writing to the school at least 48 hours in advance. Missed lessons do not entitle the student to a refund or make-up lessons. This rule also applies in case of illness or any other reason beyond the school's control.
Instructor Absence
In case of instructor absence, the school reserves the right to replace the instructor temporarily or permanently. No compensation is due to the student in case of a change of instructor. Courses canceled by the school due to instructor absence are not counted, and the student can reschedule them later in agreement with the new instructor.
Internet Connection
The student must have a sufficiently stable internet connection to participate in each lesson according to the agreed schedule.
The school is not responsible for internet disruptions across Switzerland.
Lessons that could not be held or conducted under normal conditions due to connection issues remain fully payable to the school.
Certificate
Upon request, the school can issue a certificate indicating the number of lessons attended and, if possible, the level reached according to the Common European Framework of Reference for Languages (CEFR). The price and payment conditions for the certificate are determined by the school. Training leading to official certificates and diplomas is subject to the specific regulations of the exam provider.
Video and Audio Recordings
Video and audio recordings during lessons are only allowed with the explicit consent of both the student and the instructor. The school authorizes such recordings only for educational purposes, without retention by either the school or the student.
Non-Compete Clause
It is strictly forbidden to employ an instructor or former instructor for language lessons outside of the school, whether for free or for payment. Any violation of this clause will automatically result in a minimum contractual penalty of CHF 5,000 per violation.
Data Protection
The school does not share or sell students' personal data. Only staff members and instructors have access to this data, strictly for the purpose of carrying out their duties. Data is processed solely for managing contractual relationships, administrative needs, and accounting purposes.
Modification of Course Modules, Prices, and Terms
The school may modify agreed course modules if necessary, especially for pedagogical reasons, to better suit the student's level and goals.
The school reserves the right to modify prices and these general terms and conditions at any time. However, the version of the terms and conditions valid at the time of registration shall prevail and cannot be unilaterally changed.
Severability Clause
If any provision of these general terms and conditions is found to be invalid, incomplete, or unenforceable, the validity of the other provisions shall not be affected. In such cases, the invalid provision shall be replaced with a valid provision that best achieves the original contractual objective, preserving the original intent as much as possible. This also applies to any gaps.
Governing Law, Jurisdiction, and Language
The legal relationship between the student and the school is exclusively governed by Swiss law. The competent court for any disputes, including debt collection proceedings, is located at the school's headquarters. For any interpretation questions, the French version of the general terms and any related documents shall prevail.
